By creating an account, purchasing or using a conversation, or using an AI reflection feature, you agree to these Terms & Safety Notice (“Terms”). If you do not agree, do not use SafeEar.
1. The SafeEar service
SafeEar provides a platform through which adults can connect with independent human listeners for supportive conversation and can use optional self-reflection tools. SafeEar does not promise any particular emotional, personal, relationship, career, financial, health, or other outcome.
SafeEar is not psychotherapy, counselling, diagnosis, medical treatment, legal advice, financial advice, or crisis intervention. A listener’s education or experience does not convert the conversation into professional healthcare unless SafeEar expressly identifies a separate regulated service and professional.
2. Emergencies and serious risk
SafeEar is not designed or staffed to monitor emergencies. Listeners may not know your identity or location and cannot guarantee that they can contact emergency responders. Do not rely on SafeEar when urgent or in-person intervention is needed.
Where permitted or required by law and reasonably possible, SafeEar may disclose limited information to protect a person from a credible and imminent threat, respond to lawful process, investigate abuse, or protect the platform. This is not a promise that SafeEar will detect, assess, or prevent harm.
3. Your choices and responsibility
You remain responsible for your decisions, conduct, wellbeing, and actions before, during, and after using SafeEar. Conversations and card readings are prompts for reflection only. You must independently evaluate anything said by a listener or generated by an AI feature and seek an appropriate qualified professional when needed.
You agree not to treat a listener’s comments or an AI-generated response as an instruction, guarantee, diagnosis, or substitute for professional advice. Nothing on SafeEar transfers responsibility for your actions to SafeEar or a listener.
4. Eligibility and acceptable use
You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate account information and keep your account secure.
You may not threaten, harass, stalk, exploit, deceive, sexually abuse, discriminate against, record, impersonate, dox, or attempt to meet a listener outside permitted platform processes. You may not use SafeEar to plan or facilitate violence, self-harm, abuse, fraud, illegal activity, or infringement of another person’s rights. SafeEar may restrict or terminate access, preserve evidence, and report conduct where legally required or reasonably necessary for safety.
5. Listener relationship and boundaries
Listeners provide attentive, non-judgmental conversation. Unless expressly stated otherwise, they are not SafeEar employees, doctors, therapists, emergency responders, or fiduciaries. “Reviewed” or “verified” refers only to the checks specifically described on the profile; it is not a guarantee of skill, conduct, compatibility, or results.
Do not share passwords, payment credentials, government identifiers, or information you do not want another person to hear. Calls are intended not to be recorded by SafeEar, but no technical system or other user can be guaranteed completely secure.
6. AI companions, reflections, and tarot
SafeEar clearly labels AI companions. They are automated systems—not humans, therapists, doctors, counsellors, emergency responders, or professional advisers. AI output may be incomplete, inappropriate, outdated, or inaccurate. You must independently assess every response and must not rely on AI for medical, mental-health, legal, financial, pregnancy, safety-critical, or emergency decisions.
AI companions may refuse requests involving self-harm instructions, violence, exploitation, sexual abuse, illegal conduct, impersonation, or attempts to bypass safety systems. Automated checks may identify high-risk language and display crisis resources or suggest a human handoff, but SafeEar does not promise that every risk will be detected or escalated.
AI tarot is for reflection and entertainment only; it does not predict the future. AI memory, where offered, must be enabled by the user and may be reviewed, corrected, or deleted. Private conversation content will not be used to train general-purpose models unless SafeEar presents a separate, optional consent.
7. Pricing, trials, session timing, and refunds
Free introductory sessions are available once per eligible verified client account, not once per device, login, listener, or AI companion. A human text timer starts with the human listener’s first reply; an AI text timer starts with the AI’s first reply. Once started, the displayed timer continues through disconnection or inactivity and does not pause. Rejoining does not extend the original expiry time.
Prices and included time are shown before purchase. Sessions lock at expiry unless the user expressly purchases more time; SafeEar does not automatically extend or charge for another session. A request declined by a listener, or a verified platform failure before service begins, is eligible for the refund or service credit described at checkout. Payment-provider processing times may apply. Nothing in these Terms limits rights that cannot lawfully be limited.
8. Privacy and sensitive information
Listening conversations may involve highly personal information. Share only what is necessary. SafeEar processes account, payment, safety, and service data to operate and protect the platform. A separate privacy notice should describe the data collected, purposes, retention, rights, grievance process, and contact details. These Terms do not constitute consent for any processing that requires separate consent under applicable law.
9. Service disclaimers
To the maximum extent permitted by applicable law, SafeEar is provided on an “as available” basis. SafeEar does not warrant uninterrupted access, listener availability or compatibility, accuracy of user or AI content, a specific outcome, or that every harmful statement or act will be detected or prevented.
SafeEar does not endorse or adopt user statements merely because they are transmitted through the platform. Statutory consumer guarantees and other rights that cannot legally be excluded remain unaffected.
10. Limitation of liability
To the maximum extent permitted by law, SafeEar and its platform operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for actions taken by a user in reliance on a conversation or reflection. Where liability cannot be excluded, aggregate liability arising from the relevant paid service will be limited to the amount paid for that service, except where a different remedy or limit is required by law.
This section does not exclude liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct, or other non-excludable obligations. You may be responsible for loss caused by your unlawful use, infringement, or deliberate breach of these Terms.
11. Suspension, changes, and governing law
SafeEar may suspend or close an account for safety risk, unlawful conduct, payment abuse, material breach, or platform protection. Material changes to these Terms will be presented for renewed acceptance when appropriate.
These Terms are governed by the laws of India. Courts or consumer forums with jurisdiction under applicable law may hear disputes; nothing here removes a consumer’s right to approach a forum that the law makes available.
SafeEar can offer a place to pause and be heard. It cannot take control of—or responsibility for—a person’s real-world decisions. If you need professional or emergency help, please seek it directly.
